Who processes your Personal Data?

With regard to the processing activities described in this Privacy Notice, LEDO plus d.o.o., with its registered office at Ulica Julija Knifera 10, Zagreb, Croatia, VAT/Company Identification Number (OIB) 07179054100, acts as the Data Controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”).

However, in certain cases, Ledo may process personal data on behalf of other service providers. In such cases, the other entity acts as the Data Controller, while Ledo acts as the Data Processor.

Job Applicants – Data collected through Employee Referrals: As part of our internal employee referral program, existing LEDO employees may provide us with personal data relating to individuals whom they believe may be suitable candidates for open positions. Such data may include the candidate’s personal and contact information, as well as details regarding their qualifications and work experience.

Transfer of Your Personal Data

Depending on the nature of your interaction with Ledo, we may, in certain circumstances, share specific personal data with third parties. We assure you that the purpose of such sharing is not the exploitation of your personal data, but rather the provision of high-quality and timely services and compliance with applicable legal and regulatory obligations.

Accordingly, Ledo may, depending on the circumstances, share personal data with the following categories of recipients:

  • Companies within the Nomad Foods Europe Ltd group, where such sharing is necessary to provide high-quality services and to comply with applicable legal requirements;
  • Third parties and public authorities, where necessary (i) to comply with legal or regulatory obligations; (ii) to comply with a binding instruction or order of a public authority; (iii) to prevent and/or report fraudulent, abusive, or unlawful activities; (iv) to protect the rights and personal safety of our employees and third parties; and (v) to protect ourselves against legal claims and other demands made by third parties;
  • Any other parties with respect to whom we have obtained your explicit consent to share your personal data.

In exceptional circumstances, such as a corporate restructuring involving Ledo (e.g., merger, acquisition, demerger, or similar transaction), your personal data may be transferred to another legal entity.

Your Data and Third Parties

Your personal data may be processed and transferred within the European Union, to the United Kingdom, and to certain countries outside the European Union (“third countries”), namely the Republic of Serbia and the Federation of Bosnia and Herzegovina.

The transfer and processing of personal data within the United Kingdom are permitted pursuant to Commission Implementing Decision (EU) 2021/1772 of 28 June 2021, adopted under Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) regarding the adequate protection of personal data in the United Kingdom, in accordance with Article 45 GDPR. Transfers of personal data to third countries do not require any specific authorization where the European Commission has adopted an adequacy decision for the country concerned, having determined that the country ensures an adequate level of protection for transferred personal data.

The transfer and processing of personal data for recruitment and employment-related purposes to the Republic of Serbia and the Federation of Bosnia and Herzegovina are based on the Standard Contractual Clauses (SCCs) established by Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries under Regulation (EU) 2016/679. This transfer mechanism is provided for under Article 46 GDPR and applies in situations where the European Commission has not adopted an adequacy decision for the relevant third country.

Personal data will not be transferred to business entities or other persons located outside the territories specified above. Should any changes occur in this regard, you will be informed without undue delay.

How long do we retain your data?

The retention period for your personal data primarily depends on the purpose for which the data were collected. In this regard, we assure you that we will not retain your personal data for longer than is necessary to fulfil the purpose for which they were collected.

Notwithstanding the above, in certain cases we may be subject to legal obligations requiring us to retain specific data for a longer period than would otherwise be necessary for the relevant processing purpose. In such cases, personal data will be retained only for the minimum period prescribed by law. For example, records and documents relating to daily cash transactions, accounting books and supporting accounting documentation, as well as other statutory records, must be retained for a minimum period of 10 years.

We retain the personal data of participants in prize competitions and promotional activities for a maximum of 120 (one hundred and twenty) days following the end of the relevant prize competition or promotional activity, after which the data are promptly deleted or anonymized.

We retain the personal data of newsletter subscribers until consent is withdrawn. Upon withdrawal of consent, the data are promptly removed from our subscriber database.

We retain the personal data of job applicants in accordance with the following rules:

  • Unsucessful Candidates: The personal data of candidates who are not selected during the recruitment process are retained only for the duration of the recruitment campaign, i.e., until the recruitment process has been completed, after which the data are promptly deleted or anonymized.
  • Successful Candidates: The personal data of candidates who are selected and enter into an employment relationship with us are retained for the duration of the employment relationship and, following its termination, for the retention periods prescribed by applicable employment legislation.
  • Retention for Future Recruitment Purposes Based on Consent: Exceptionally, where you have expressly consented to the retention of your application for future employment opportunities, we may retain your personal data after the completion of the relevant recruitment process. You may withdraw your consent at any time without any adverse consequences.

Finally, please note that, subject to the conditions set out in the GDPR, you have the right to request the erasure of your personal data held by Ledo. Detailed instructions on how to exercise this right are provided in the section titled "Automated Decision-Making and Profiling

Ledo does not make decisions based solely on automated processing of personal data, including profiling, that produce legal effects concerning you or similarly significantly affect you within the meaning of Article 22 of the General Data Protection Regulation (GDPR).

Should any automated decision-making or profiling activities falling within the scope of Article 22 GDPR be introduced in the future, individuals concerned will be informed in a timely manner, including information about the logic involved, the significance and envisaged consequences of such processing, as well as their rights under applicable legislation.

Children's Privacy

Ledo is fully aware that children constitute a particularly vulnerable group and therefore pays special attention to the protection of their personal data.

In this regard, Ledo complies with the provisions of Croatian law concerning the minimum age required to enter into legal transactions, including those relating to the processing of personal data. Among other things, we will seek the express consent of a child’s parent or legal guardian before providing certain services or granting access to specific sections of our website.

Automated Decision-Making and Profiling

Ledo does not make decisions based solely on automated processing of personal data, including profiling, that produce legal effects concerning you or similarly significantly affect you within the meaning of Article 22 of the General Data Protection Regulation (GDPR).

Should any automated decision-making or profiling activities falling within the scope of Article 22 GDPR be introduced in the future, individuals concerned will be informed in a timely manner, including information about the logic involved, the significance and envisaged consequences of such processing, as well as their rights under applicable legislation.

Your Rights

To ensure effective control over the processing of your personal data, you are entitled to a number of rights which, in the circumstances prescribed by law, may be exercised directly against Ledo.

These rights include:

  • The right to obtain confirmation as to whether Ledo is processing your personal data and, if so, to receive detailed information about such processing;
  • The right to access your personal data and obtain a copy of the data in either physical or electronic form;
  • The right to request the rectification of inaccurate or incomplete personal data that we hold about you;
  • The right to request the erasure of your personal data;
  • The right to request the restriction of the processing of your personal data;
  • The right to request the transfer of your personal data to another data controller;
  • The right to object to the processing of your personal data by Ledo, particularly where processing is based on Ledo’s legitimate interests for direct marketing purposes or involves automated processing;
